Wiggle Time Photo Centre - Data and Digital Image Storage

1. Wiggle Time Photo Centre ('The Retailer') agrees that information concerning their customers will be held by WHITECH and may be used to enable both parties to perform obligations defined in this Agreement. WHITECH acknowledges that the names, addresses and other personal details of the Retailer's customers that are directly or indirectly disclosed to it under this Agreement (Customer Details), are the property of and confidential to, or comprise a trade secret of, the Retailer. While under contract WHITECH will endeavour to:

1. Keep the Customer Details confidential and not directly or indirectly disclose, divulge or communicate those details to, or otherwise place those details at the disposal of, any other person without the prior written approval of the Retailer;
2. Take all reasonable steps to secure and keep secure all of the Customer Details coming into its possession or control;
3. Not memorise, use, modify or make copies, notes or records of the Customer Details for any purpose other than in connection with the performance by WHITECH of its obligations under this Agreement; and
4. Comply with all applicable privacy and consumer laws

1. WHITECH's obligations of confidentiality under the above clause do not apply to any information that:
   1. Is generally available to the public (other than by reason of a breach of this Agreement); or
   2. Is required to be disclosed by any applicable law.
